Springfield, VA asked in Landlord - Tenant for Virginia

Q: Is it legal for a landlord to NOT rent under the VA Code? My landlord says they don't and we have mold in our house

My house has a mold problem and all of my roommates and I have gotten NUMEROUS respiratory infections over the past year. I emailed my landlord asking them to have it inspected for toxic mold and they said they did (but it seems like they just brought a friend to look). When I asked them to provide us with results, they wouldn't. I found information through Code of Virginia- Virginia Residential Landlord and Tenant Act (Subdivision A 10 of 55-248.16) but they responded to me saying they do not rent under VA Code. They will not do further inspections of the home or try to remove the mold. We are all having breathing issues. They also won't let us move out since our lease doesn't end for another 5 months. Is it legal for a landlord to force you to continue to live in a mold infested basement?

A: I do not understand your question. The Virginia Code does not provide for whether or not a landlord can rent a premises.
