Q: What to do? Landlord brings us 3 day notice to get out saying we remodeled house without his permission but not true

We had a year lease renting a home. The lease was up in February of 2017. So we've been paying month to month since. We were thinking about buying the home but we found out it was full of termites. So the landlord hired a company to conlme spray. They said door frames had to be removed. We removed them per landlord. Now he brings us a 3 day notice to get out and said it was due to us remodeling the home without his permission.

A: In Ohio, a month to month lease can be terminated at the end of a month by either landlord or tenant giving at least 30 days notice. If tenant does not leave at the end of that month, then the landlord gives a 3 day notice. A 3 day notice is also given if rent is not paid on time. All other alleged lease violations require a 30 day notice to start an eviction. Advise the landlord of that. If the landlord does file an eviction based on the 3 day notice, then you must attend the eviction hearing, tell the magistrate that you did not get a 30 day notice, and the eviction likely will be dismissed. The landlord then will have to do it again properly, and will be able to evict you by doing the eviction properly the second time.
