Q: Can I file a claim of Boundary by Acquiescence?

I have purchased trailers and built two substantial outbuildings and have lived here for 34 years. I purchased the property (land contract) in December 1980. I have Homestead Exemption and have a deed recorded at the Washington County Court House. Yesterday a neighbor accused me of squatting on his land (which he purchased in 1988). He is having a survey done sometime next week. When I purchased, the land had reverted to the original seller and exact property boundaries were impossible to determine. Although I believe the trailers and outbuildings are on my right of way, it is possible that they may slightly infringe on his borders.

A: I suggest that you will need a real estate attorney from this area as real estate disputes often involve the need for the attorney to personally visit the property to inspect the same.

The above being said, I suggest that you should wait at this point until this person produces a survey which specifically identifies that your buildings encroach upon his land. I will be happy to discuss with you in the future as I handle real estate litigation cases all over NW Florida. My office is located in Santa Rosa Beach a little over an hour from Washington County (Chipley), depending upon where your property is located I might even be closer.
