Elmont, NY asked in Consumer Law for New York

Q: Can I get out of a truck purchasing deal if the lending company already paid the truck company?

The lending company already paid the truck leasing company. Because it was a truck leasing company and not an official truck dealer, the red tape is ridiculous to secure the title, so I still don't have possession of the truck. I am not happy with the truck company and don't trust them long term. I am ok with losing my $500 deposit to secure the truck, and even the $995 fee we had to pay the lending company to start the loan process. Those were non-refundable. Is there any option for me? Both the lending company and the truck company say we can't get out of the deal. Please advise. Thank you.

A: The documents will govern the transaction. If you purchased the truck by having a leasing company purchase it, and then your lease is with them, which you are calling the lending company, then they are probably right. The bank is not involved with your title issues. Red tape to secure title makes no sense, unless something else is up. You just get their title and turn it in to DMV.
