Lawrenceburg, TN asked in Divorce, Family Law and Child Custody for Tennessee

Q: Do I have to make my son attend a sport he hates?

My son is 8 years old. His dad signed him up for baseball last year. He hates it but we had him stick it out. This year he signed him up without asking him and he felt like he had to agree to it. He hates going and begs/cries to not go. I would love for him to play a sport but baseball isn't his thing. His dad is taking me to court for contempt because I have decided that this year I will not force him to be involved in an extracurricular activity he hates. He is active with boyscouts and loves it. So he is involved with something outside of school. He also plays basketball and enjoys it during the winter months. We have joint decision making on activities. Am I in the wrong for not forcing him to go? Am I in contempt?

A: If the parenting plan form says you have joint decision making on extracurricular activity, and the father signed the child up without your joint agreement, HE has violated the order and he may be in contempt. Proving that in court may be difficult, especially if the boy played last year- the father will claim you already agreed to it. The boy needs to communicate with his father that he does not like baseball.
