Q: Are both parties need to pay child care expenses (split 50%/50% the cost) if only one party is incurring costs currentl
Part B: Although no work related child care expense presently exists, in the
event that such expense be incurred by a party in the future, each parent
shall pay his/her proportionate share thereof, which is to say,
Respondent's share is 50.0% and Petitioner's share is 50.0% of such
expense. In the event that such expense be incurred by either party, that
party give to the other party documentation from the child care provider
which shows the total monthly amount of such expense and, on the first
day of each month, the other party shall pay to the party incurring such
expense his or her said share of such monthly expense until such time
as further documentation is provided that the actual amount of such
expense has changed, at which time the party not incurring such
expense shall pay to the other his or her said parental percentage
thereof.
Part C gives more detail but cannot fit in this text box.
A:
Hello:
Based on the information you provided, if either parent incurs child care expenses, both parents are then responsible for 50% of that cost.
In other words, if dad has custody and has the child in day care, he should present proof of the expense to mom. Mom would pay her half of the cost of the daycare and dad would pay his half of the cost of the daycare.
Hope this answers your question!
