Q: I'm withholding rent due to not having windows in my house He then gave me an Eviction to pay or quit What are my rights
I moved into a house back in December and was told that the house would be ready. I signed a 15-month lease and when I got the keys to the house it was not ready. I took pictures of the house. The week after we moved the properties handyman came and took a window out of the frame. did not try and cover it up or nothing. it sat like that all day until I got home to cover it. with him taking that window the house knows did not have 3 windows. As of today, I still dont windows. This house was to have 2 bathrooms but was told before moving in that they would be working. The upstairs bathroom was leaking to the downstairs. Management was told about this. I have all this in Emails. Mold started to grow. I called the state in January. They did nothing. I started to withhold my rent in March. Soon after the ceiling fall exposing more mold. Beginning of April a new management took over. gave us 3 day notice. We filed an answer telling the courts that the house is not Habitable.
A: If you want to stay, you will need to pay rent. If you want to leave, you may not need to pay rent. If the landlord is seeking back rent in the eviction, you can present evidence (which is very strong) of constructive eviction via the very poor condition of the rental.
