Q: At my job I get payed $8.00/hr plus $1.00/hr for tips. If I made $100 in tips but only received 1 per hour is that legal
I am working a summer job at a Coldstone Creamery in Georgia. I make $8.00/hr plus $1.00/hr for tips. So if I work an 8 hour shift I get $8.00 in tips. Now on one day I was working with to other people for nine hours. so theoretically that would be $27.00 for tips. that day we made around $115.00 in tips but we each only got $9.00 for it. Is that legal under the Fair Labor Standards Act? If not what are my options?
A: If the tip is for you it is your tip and the employer cannot take the tips or use any part of it. If it is a tip pool at horse being shared with other servers and tipstaff that's a different story
