Macon, GA asked in Family Law, Child Custody and Child Support for Georgia

Q: When my husband signed the birth certificate, did that make him legitimized?

My husband and his child's mother were never married but he pays child support, has had a paternity test done and he signed the child's birth certificate at birth. We are trying to find out if he is legally legitimized. I am seeing a lot of conflicting things online. We are in Georgia so I know the laws are pretty crazy for unwed fathers.

A: There is a lot of conflicting information online. Part of that is because the rules were overhauled in 2016. The short answer is, unless there is a notarized, filed consent to legitimation on record prior to July 1st, 2016, then the father signing the birth certificate does not make him the legitimate father.
