Q: How do I retrieve a vehicle from a mechanic that will not return calls and was prepaid 6 months ago?

I have a receipt, but it is not itemized. The reciept has mechanic's name and amount paid.

A: File a lawsuit- in Tennessee, you can do this in "General Sessions Court" the court clerk may have a form you can use- it would be called something similar to " action to recover personal property" or if they don't have that form, use a "civil warrant" and just describe what you want ( identify the vehicle, make, model, year etc). There will be a fee to be paid at the clerk office when you file and you will need the address of the mechanic so the sheriff can deliver the court papers to him. if you win the case, the court fee will be assessed against the mechanic. Before you spend the money at the court house, I would go to the mechanic shop and lay eyes on the vehicle to make sure its still there and ask the mechanic to let you have it. In other words, try to get the car. He still needs to refund the money, but just getting the car back is some progress. You can always sue him for the refund later on.
