Q: I'm in the middle of a divorce and I believe I have just been blackmailed and don't know what I should do.

I have asked my wife for a divorce. For various mental/medical reasons, my wife needs help during the divorce process. Her sister is helping her. We both have lawyers and have been through an unsuccessful mediation process but we continue to barter over the terms of the agreement to preclude going to trial. The agreement I am presented with continually asks for more money than I am comfortable parting with (I am 60 and have retired). Recently my wife's sister threatened to disclose a legal indiscretion from my past & an affair I had recently if I don't sign the MSA offered by my wife. The sister knows I don't want this to go to court because it's money I'd rather give to my wife rather than to the lawyers. I'm not really sure what to think or do. I have not mentioned her extortion attempt at all in my correspondence with her. I've never been blackmailed before and will not be blackmailed... I would openly admit to my actions before submitting to these tactics.

A: It sounds like you've already made a decision. The cases I like the best are the ones just like yours where I can tell opposing counsel to take their offer of extortion and shove it where the sun don't shine. Remember, if you were to go to jail, there would not be any money whatsoever for your soon-to-be ex-wife. So it is highly unlikely that they would do that. Stay strong. So long as your comfortable with your lawyer, and your lawyer is good, you'll be okay. Good luck!
