Victorville, CA asked in Education Law for California

Q: Habitual Truant charges by SARB board who have ignored the disability of my children and their rights.

I am a 100% Army Combat Veteran, I served with the 2nd Armored Cavalry Regiment in Iraq. I developed health issues due to the exposure to chemical agents such as Sarin, Mustard Gas, Depleted Uranium, fallout from burning oil wells and experimental drugs given to us to fight against nerve agents if so exposed.

My children have been born with the same issues I have, the VA and DOD call it the "Persian Gulf Syndrome".

I have PTSD and a TBI also. My children have been through allot but even with having a health plan in place, a letter from the Doctor explaining their issues they won't take that as an excused absence. We have been to SARB, to court and fined $300, we don't know what to do. They are not being reasonable, didn't inform us of other educational options for my kids, yet insist theymuch come to school, even when sick.

A: Are you homeschooling the kids? They need to be schooled in some way, and a disability is not a defense to that requirement. If the kids are absent from school for issues related to illness, proof is required from a doctor. If provided and not accepted, why? More details are necessary to provide a professional analysis of your issue. The best first step is an Initial Consultation with an Attorney.
