Shelbyville, TN asked in Real Estate Law for Tennessee

Q: I purchased a home that my driveway is 6 inches into my neighbors yard. Do they have rights to my driveway?

I purchased my house before my neighbors purchased theirs we are butting heads about property lines cause they trespass on a regular basis. I even almost accidentally run over their 2 year that ran out in front of my car in my driveway. They don't watch their kids at all.

A: I suggest you talk to your neighbor and request that you both hire a good surveyor ( each of you to pay half the fee) to locate and mark the exact boundary. Then, each of you pay half the cost of building a strong fence on the boundary. There is an old saying that "good fences makes good neighbors" and it has some truth to it. If he won't agree, you may decide to pay for all of it yourself, but it may be worth in the long run.
