Q: Can local police tell me I have to babysit my dog while it is in my backyard ? They said she was aggressive.

I live in Greeley Colorado and was recently informed by the police that my dog is aggressive and that I have to attend my dog while she is in the fenced yard. Can they just label my dog aggressive off of here say ?, And can they make me babysit my dog on my enclosed property ?

A: The police cannot arbitrarily label your dog aggressive. You have to be charged with an aggressive/dangerous dog offense and be convicted of same in court. If this has happened, there are specific statutory conditions that are placed on how the dog is kept once the conviction is in place. The judge may also order additional conditions tailored to the circumstances. If your dog has been wrongfully convicted of being an aggressive dog, you might want to consider hiring an attorney to appeal the conviction (if your appellate rights have not lapsed).
