Portland, OR asked in Employment Law for Oregon

Q: I was excluded from a job I qualify for because I was not provided with a testing time that is required for the job.

I applied for a job and was accepted into the second round of the hiring phase - during this time, you are required to take a test before a deadline before you can move on to the actual interview portion of the hiring process.

The problem is that they accepted me into the second round AFTER the testing dates they provided had already passed, and are now rejecting me as an applicant because I didn't complete the test (even though it is literally impossible for me to have completed this test, as they did not provide me with a testing date.)

My question is, is there anything I can do? Do they have to provide me with another testing date? Or can they actually reject me, even though I am qualified and they accepted other candidates, because of their own scheduling mistake?

A: Assuming this is not a government job or a union job, then likely there is nothing to do. Now, if you think they did this because you are in a protected class, then that changes things. However, you mention nothing about discrimination.
