Q: How long does a PA state trooper have to issue a citation?

We were involved in a traffic accident 3 weeks ago, my 20 year old daughter was driving. She made a left turn at a traffic light and we were hit in the back end (100% behind the rear wheel) of our vehicle when we were 3/4 of the way into the roadway we were turning into. He hit us in the shoulder of the road. The other party's "friends" loaded up his vehicle onto a rollback and moved it into the parking lot before the police got there. His vehicle was not obstructing traffic. Ours was partially obstructing a turning lane. The officer told me that my daughter was at fault because she made the turn and he had the right of way. How long does he have to cite her? If he does cite her, should we fight it? My insurance company is going after the other driver due to the amount of damage to our vehicle and where on the vehicle we were hit. He totaled our Denali with a little Honda Element in a 35 mph speed zone.

A: Possible depending on the area. You all may have injury claims and should use the medical to see a doctor if you were hurt. Contact a member of the Pa. Assn for Justice--we give free consults so you can have your case evaluated. If you don't already get a copy of the police report. Don't say anything about the crash when ordering it.

If your insurance has a copy get a copy. Generally, something like this you will get the citation either on the spot or by mail within 1-2 weeks. Unlikely at this point but not impossible.
