Oxnard, CA asked in Employment Law and Employment Discrimination for California

Q: Is my pay at work legal and or fair? Can my Boss do these certain things he does to me...?

I work 55-60 hours weekly, 6 days a week 10 hour days, rountinly I'm forced to stay late after my shift ends or show up early, but I'm payed no overtime ever. I get payed 2000 dollars salary a month, at 10.00 dollars an hour, it doesn't seem my salary is fair, am I entitled to overtime pay? I cut my finger at work, it got infected, I went to the hospital on my day off called in sick, the next day the boss said he was gonna shorten my pay on my check unless I came in on my day off , so now I gotta work 7 days straight, no overtime pay, with a infected finger, ....is everything fair and legal? Can my Boss hit me? He does, when I make mistakes, maybe being from Korea he's different but the stress is killing me bad,

A: You need to go to the Labor Commissioner and file a complaint to get all your backpay and overtime due you. Also, your employer may not assault or batter you while at work, or any other time.

Here's the website for the Labor Commissioner: http://www.dir.ca.gov/dlse/HowToFileWageClaim.htm
