Q: property with no will

My mother and father had property together, they had myself and my sister together this is the only children my father has. My parents divorced and my mother signed over all rights of the property to my father. My father remarried and never added his new wife to the deed. My father passed recently and did not have a will either. This is in the state of Pennsylvania, can you please provide some input if my sister and I are entitled to any portion.

A: An estate needs to be opened, and you would need a lawyer to do that. You and your sister should be entitled to half the property, or the net proceeds of the sale, and the surviving spouse would be entitled to the other half. The half for you and your sister would be subject to a 4.5% Pennsylvania inheritance tax, whether the house is sold or distributed in kind.
