Easton, PA asked in Family Law and Child Custody for Pennsylvania

Q: What types of things can be held against a father when determining more visitation time and overnights?

The father complains about not getting more time with the child but during his visit time he is granted he is playing in an adult softball league instead of visiting with his child. How old should a child be in order to have over nights at the non-custidal parties house? The father lives with his mom, dad, sister, sisters boyfriend, brother, and the fathers new girlfriend. The child does not have a room of her own, and he stated she would sleep in a "Pack n' Play". The father also has 2 charges of drug possession. One while being a passenger in a vehicle and the other while driving a vehicle, along with multiple violations for driving on a suspension.

A: It's impossible to know what the result of this scenario would be. I am providing you with the link to the custody statute. Read sections 5328-5330 in particular because that's where you'll find the 16 factors the court must consider when determining what a custody order will be. I strongly urge you to consult with an experienced family law attorney in your area to discuss the details of your particular situation in greater depth.
