Stockton, CA asked in Employment Law and Employment Discrimination for California

Q: Am I eligible for unemployment

I worked at Amazon thru a temp job. The temp agency's contract was over with Amazon and they would be letting all the temps go unless Amazon offered them permanent jobs . Amazon offered me a Saturday thru Tuesday NIGHT shift. Anytime I applied for a permanent job I always put Monday thru Friday day shift cause that's my availability due to transportation. I live 30 miles for Amazon and currently don't have a working car. The bus also doesn't run on weekends I looked into it. I have a letter from the temp agency saying they let me go due to a ramp down. I also have an email from the head account director stating I was eligible for unemployment. now the temp agency is claiming Amazon hired me which is true according to their system because their was a system error in the last two weeks I worked at the temp place. It had my employee portal all messed up showing I was an employee at Amazon. Is my reason for not accepting the Amazon offer good enuf to continue to receive unemployment

A: It seems to me that your transportation problems are not the fault of your temp agency or Amazon. You were offered a position which appears reasonable on its face. You haven't provided sufficient information to allow me to conclude whether there were other transportation solutions available to you. For example, did you check with Amazon's HR department to see if they might have any transportation solutions for you. Perhaps, like many companies, they have shuttle buses running from major residential areas. Did you even ask them?

Whether your reason for rejecting the offer of employment is reasonable or not will be decided by the unemployment appeals board if Amazon challenges your right to unemployment benefits.

At the least, I suggest you contact Amazon again and speak to someone in human resources (HR) about whether they might have any ideas about how to deal with your transportation issues
