Q: My roommate wants to kick us out. She said we are her tenants but she isn't the landlord. Can she kick us out?

She told us today that she wants us to move out. She said that on the lease, we are her tenants but she isn't the landlord. Can she legally kick us out or can only the landlord kick us out?

A: The answer will depend on whether or not you are tenants or sub-tenants. If you all rent from the landlord, you are all tenants. If you rent from her and she rents from the landlord, you are sub-tenants. If you are sub-tenants, she can evict you. If you are tenants to the landlord and not to her, only the landlord can evict you.

Easiest way to figure this out is to review your lease agreement. If she is not the person you rent from, you do not have to worry about her evicting you because she does not legally have that power.
