Q: My husbands ex wife initially got home in divorce, she is not on mortgage but did have to sign papers when they closed.

She failed to make mortgage payments and my husband hired real estate attorney to essentially take the house back from her before it was foreclosed on. Essentially we moved in, fixed it up and now we rent it out to family. We haven recently become concerned that if something were to happen to my husband. Is she still on title/deed? Does she have rights to home which has a lot of equity? We want to know how to remove her from any rights and add me. My husband and I have been married 9 years and have put a lot of money in that house. I would be horrified to know she got the house if something happened to him. She has not had anything to do with that house for 13 years.

A: I would expect the real estate attorney obtained some type of deed. I suggest contacting them, looking through the real property records of the appropriate county as well.
