Atlanta, GA asked in Divorce and Child Custody for Georgia

Q: Can my husband's ex wife prevent my husband from adding me to the pick up roster for the children at their daycare?

They have joint custody, she is primary and receives child support. The other day we went to pick up the kids and add me to their pick up roster and the director told us that the ex wife had instructed for me not to be added to pick up the children but she has her fiance on that roster that isn't by blood or marriage.

A: She does not have to add you to the pick up list. This should have been addressed in the custody paperwork. If it wasn't he can file a modification and ask to have you added. Otherwise, there isn't a way to force the issue.

A: I agree with attorney Edwards. Unfortunately, if it was not addressed in the original custody order, he will need to modify to add a provision that he or a person he designates is permitted to pick up the child from school/day care for his visitation periods.
