Asked in Traffic Tickets for North Carolina

Q: I got a speeding ticket (78/60) in VA but my license is from NC .

I got a speeding ticket (78/60) in VA but my license is from NC and I paid the ticket immediately not knowing that this ticket could be a reason for suspension. Two months after, I received a suspension letter from NC DMV with option of a hearing by mail . I request a hearing and then I received a second letter stating I had been schedule for a hearing by mail by September 26, the same letter suggested to take defensive driving course, my question is how to write the summary for the hearing (what to say and what not) in order to get the ticket dismissed? Is this probably? I had a pretty clean driving record since I started driving in the US three years ago.

A: The circumstances of your question make no sense what so ever. If you got a ticket in VA, who cares where you are licensed? You need to talk to a VA traffic attorney. If you received a suspension letter one of two things is the case. If the letter came from NC DMV then you likely missed your VA court date and have likely added a few extra hundred dollars to your total to get this mess cleared up. If you received a suspension letter from VA, they have no authority to suspend your NC license but they can suspend your privilege to drive in VA. How the possibility of attending a defensive driving school got mixed into a suspension letter - I'm not sure - that isn't normal for NC. As to getting the ticket dismissed - that likely ain't happening but a VA traffic attorney may be able to keep you from getting suspended and maybe avoid an ibsurance increase. As to your question about what to write, based on what you have written here - you shouldn't write anything. Call a VA traffic attorney ASAP before you muck this up any more than it appears it may already be. Best of luck!
