Novi, MI asked in Real Estate Law and Landlord - Tenant for Florida

Q: New complex owners say they have done a Termination of Association and that my current lease is void? can this be done?

I signed lease with property management company that owned a townhouse in the complex which has been bought out, new owners paid management company for the unit, now they are saying my lease which is good until 3/31/2018 is void, that this was not a buy out that they did a Termination of HOA and that makes the lease invalid. There a no clauses in my lease referring to this or any sort of early termination except for non payment.

A: Your situation is more complex than this forum is intended to deal with.

You need to consult with a real estate attorney from the area where your rental property is located.

Without reviewing your lease my initial thought is that the company cannot legally take this action. But hire a lawyer to look into it.
