Fresno, CA asked in Civil Rights, Internet Law and Libel & Slander for California

Q: I was wondering what the rights would be for a woman with schizophrenia. she has paranoid disorganized schizophrenia

There is a woman in the neighborhood who seems to be somewhat harassing my mother, a disabled woman with paranoid disorganized schizophrenia. This woman is posting pictures of my mothers house (with the address) to social media saying her house is a homeless tweeker encampment. My mothers schizophrenia causes her to be very disorganized and things are a bit in disarray. I just moved back to try to help her get the place back in order.. and I am now dealing with code enforcement and this woman recruiting everyoone in the neighborhood to call the county on my mother to get her kicked out of her house! It is obvious slander and libel! She drives past the house almost every single day taking photos! What can I do?

A: Is your mother the subject of a legal guardianship or conservatorship? Have you been appointed her legal guardian or conservator? If not, you should immediately take steps to be appointed one or the other. You will need to retain the services of a probate lawyer or conservatorship attorney who practices in the local courthouse near where your mother resides.

Once you have been appointed, then you can start taking legal steps on behalf of your mother, such as suing the neighbor for libel based on the postings she has made. You should discuss this with a lawyer who has experience in libel and slander cases.
