Q: Hi, I've had a temporary custody order of my 16yr old and his father is not wanting to return him as agreed. What to do

I've had the temp order since 2003, his father has never really been involved but agreed for sons sake to let him have the summer with him and now he is saying he isn't going to make him come home if he doesn't want to... is there anything I can do or is this a loosing battle. Please help, thanks...

Note: My husband is in the US Army and we are currently living in Washington state, the court order was issued I Oklahoma.

A: I don't understand why you've had a TEMPORARY order for so many years. Nevertheless your best bet would be to You should consult an experienced Family Law attorney in Washington for help. He could file for a Writ of Habeas Corpus, which in most states does not require that you pay court costs, and you get an almost immediate hearing.

Another option would be to contact the legal offices on his base to see if they can help get your son promptly returned. Good Luck!
