Q: My husband had an affair which resulted in a baby. I am filing for divorce. He now wants half of my assets. Does he have
to report any monies received from the marriage settlement to his child support for his child? He is saying he does not have to report it.
A: Generally speaking he is correct. Child-support, for the most part, is based on income, not assets, unless of course the assets generate income, then it's calculated on the income from those assets as well.
