Apopka, FL asked in Contracts and Real Estate Law for Michigan

Q: Sign and lock box on property...no sales contract...is this legal??

Asked the agent to give me a market evaluation. My tenant called me and told me she put a for sale sign out front and asked him to place a spare key in the box. I hadn't even heard from her or seen a listing contract. Is that legal?

A: That would constitute a trespass if you AND THE TENANT didn't authorize the placement of the items on the property.

It sounds like the agent is using the 'confusion' caused by a tenant occupying the property to her advantage. If you DO hire an agent (ANY agent not just this one), this will quickly be 'resolved' however. Are you SURE you didn't sign anything? Sometimes things get handed to you and you don't necessarily read them carefully? Without a complete examination of the facts it is impossible to say for sure what is going on here.

Did you get a copy of EVERYTHING you signed? Please review this carefully and don't assume! And if all else fails, seek counsel from a local real estate attorney to review the whole situation.
