Sarasota, FL asked in Child Custody, Divorce and Family Law for Florida

Q: My husband and I are going through divorce. My husband took a couple of videos of me.

The videos are just picturing our altercations - they were taken without my express consent but I knew he was filming. I would like to get a hold of those videos because - I think - he actually makes points in them the support my case. For instance - he would make negative statements about me in front of the kids and then on video say "well, that's not bad". Or, in another instance, he is telling our son on video how boring the pre-planned trip destination would be and how much fun they would have at another place, but then his plans changed and he took our son to the originally planned trip destination. He manipulated him to match his agenda. This is one way for me to demonstrate that he does not put the kids' interests ahead of his own. How can I get the videos? I am pictured in both of them. We are having a social study performed for our custody case and I would like to show the videos to the social study investigator. Thanks.

A: During your interview with the social investigator tell them about the videos. You can also request copies of the videos through the discovery process.

A: Serve and file a Request for Production of Documents and Things. List the video within the request. Good luck.
