Q: In order for an attorney to deal with a Malpractice situation. Do I pay them before or once it's all dealt with?

My mother is wanting to sue a dentist for malpractice. Have evidence and all. I just wanted to know if we'd have to pay an attorney before they start their job working on the case or after? Or is probate the way to go? Any legal advise helps! Thank you!!
