Q: Mother has custody. Father has visitation every other weekend.

My daughter moved 4 hours away without telling the courts or the father. She brought my granddaughter for his visitation and he kept her. He states he had the order modified and there will be a master hearing. My granddaughter does not want to move with her mother. She is 10 years old. She wants to live with the father. At the hearing can the mother take her back?

A: There is a relocation statute in PA that governs the procedure to be followed if a parent seeks to move a child a distance away from the other parent. It appears that your daughter did not follow this procedure. Yes, a judge can give the child back to her at her new location or tell her to return the child to the prior location. Your son should retain an attorney.
