Kenosha, WI asked in Animal / Dog Law for California

Q: Selling my dog with consent?

EDIT: question is suppose to say WITHOUT consent.

I'm in the Military and was stationed out of state. We had an oral agreement with my mother and brothers that they would take care of my dog. Now after a year being there with the family husky my 27 year old brother who still lives with my mom is saying my dog causes too many problem and they want to give him away. I refused because my dog is a Pure bred Boxer I bought for $1,000. I told them if you don't want him there then let me find someone. But my question is: If they give away my dog without my consent, before I am able to rehome him, am I able to Sue for what I bought my dog for?

A: Selling the dog, or giving it away, without your consent would probably be a crime, since the dog is your property. You could sue if they did that. However, you cannot force them to care for your dog. They could probably take the dog the Animal Control and surrender it, where it would either be adopted or put down.
