Dayton, OH asked in Landlord - Tenant for Ohio

Q: If I moved into apartment with all utilities included in the winter and gas was off , what can I do ?

I was 9 months pregnant with a three year old , moved in the winter . Paid rent plus deposit just to walk in and find out there was no gas/heat . Landlord kept telling me someone was going to come out and no one ever did . I found out from calling gas company that my furnace had an issue and it needed to be inspected by city before any one can occupy the apartment . It was never fixed and it's getting cooler and I don't have heat still . What are my options ? Also I have a written statement from my landlord stating it will be fixed by 3/31/2017

A: Send a written notice to landlord that the problem has not been fixed. If not fixed in a reasonable time, like 2 weeks, then you can start paying your rent each month on time into escrow with your local court. Landlord will have to explain to the court what is being done to fix it, and if not sufficient, the court can terminate your lease and you can leave. Check with your local court for the escrow process.
