North Port, FL asked in Divorce and Family Law for Florida

Q: Married but separated for 10yrs. Cant locate wife or child. Last known to live in another state. How do I proceed?

I got married in 2004 and have been separated since 2006. We have a child, but child does not live with either of us. Spouse was in and out of jail and now spouse and child are unable to be located. I have searched and last known location was North Carolina. How do i start the divorce proceedings? Can I do a simple divorce in florida with one signature? How long does the process take?

A: So long as you have been a Florida resident for at least 6 months, yes, you can obtain a divorce in Florida. Based on the information you provided, the process may take anywhere from six months to a year. I highly suggest you have a skilled attorney do this for you because this is a complex matter as a child is involved. Good luck!
