Elmhurst, NY asked in Real Estate Law and Landlord - Tenant for New York

Q: I live in NYC & Its August, if i serve a 30 day Notice of term will the courts make me wait since holidays are close?

Tnts are terrible and we want to sell our home but first renovate for a better price. Since they moved in they have installed their own lock and not given a copy of the key to us. They ruined the apt but now we have a complication that the tnts older daughter is pregnant by at least 7 months. We have repeatedly asked for the apt since last year but were giving them time since its hard to find an apt in nyc. Will the judge screw me into giving them an extra time to move? And if it will most likely happen do they still have to pay rent? What happens of they stop paying even if the court gave them 6 months? I am asking bc have 1 friend who couldn't get a tnt out after the 30 days bc the judge gave them extra time since it was close to the holidays.

A: I do not understand your issue. Serve a 30 day notice. Holidays have nothing to do with it. I do not know what the 6 months refers to.
