Wayne, NJ asked in Real Estate Law and Landlord - Tenant for New York

Q: i rent apartment in 2 fam house since 2014/no lease--person living there told me she was owner--rec'd notice from bank

foreclosure--No will--Nothing else in his estate--2 other sisters want nothing to do with house. Father took mortgage on house 2 months before death in 2011 --sisters got money so they don't care. At no time did she have the authority from owner to rent apartment--she has some mental issues and is now acting more strangely, harassing our family, making all kinds of accusations, telling us who can visit, and just being vicious. We know we need to move but in the mean time-. Question is are we legally required to pay the rent to her or should we contact the bank to make arrangements. She also has a security deposit that she claims she can keep--she has not given us any written notice to vacate

A: If she is not the owner, I would pay no one at this point, and just put the money away in case someone sues to evict.
