Q: Are the parents required to live in the same school district if they agree the child should go to that school?

They are divorced and have 50/50 joint custody. My boyfriend said the judge said they had to live in the same school district and if one moved out, he would revisit custody. Is that true? He wants to move in with me in another school district (and keep his daughter in the school district she is in because it is the better school) and afraid if he does, the judge will grant his ex-full custody. We are in Lehigh County, PA.

A: It could be true. If your boyfriend had an attorney for his custody case, he should ask him this question. If he had no attorney, then I suggest he schedule a consultation with an experienced family law attorney located in the county where the order was entered. Someone needs to review the custody order and possibly the hearing transcript. However, you should both be aware that, in PA, custody is always temporary and subject to change.
