Melbourne, FL asked in Divorce, Family Law and Child Support for Florida

Q: Can her boyfriend's support count as income? He pays mortgage and much more. Looking to recalc CS.

She pays me $246/mon and was out of work for 5 months but got a new job little less income she says. But boyfriend moved in and has been paying mortgage and nearly everything else from what I hear. They are remodeling house, going on vacations and more. My question is about her "income" on the FA for her. Considering he is paying so much of her debt and Mortgage (all in her name), should her income go up on that form being he gives her money and pays her bills?

A: No, he is not responsible for her child support, and what he contributes doesn't count as her income.
