Q: I had a car accident in Pittsburgh, PA. I am not injured, the other guy is not injured, but just my car need to be fixed
since i don't have collision on my insurance and i have limit tort, what can i do to have my car fixed without paying money?
Adds on: i just called the police, they told me there was no police report because no one was hurt and no one's car been towed by police. How do i know who caused the accident?
A: If the other driver was at fault, you can demand that his insurance company pay or, if it does not, sue him. If the other driver was not at fault, there is nothing you can do.
A:
You want to get two estimates from places you'd want to use. Submit them to the other company. How do you know who caused the wreck? Well, you were driving and seem to feel it wasn't your fault, so you work from there. Why wasn't it your fault? Why should the other company pay?
Limited tort deals only with injuries. Before you need to give a taped statement you need to have an idea of what you'll say.
Even though you claim you weren't hurt, I'll give you a free consult just so you don't step in a hole you dug for yourself.
By the way, limited tort is a tool of the devil. If you had been hurt it would make it hard to make a case for your injuries and as a result hard to get the free legal help that members of the Pennsylvania Assn for Justice give through contingent fee arrangements.
A:
To answer your questions, if police responded they may have filled out a note as to a non reportable accident that will discuss who was at fault.
As to limited tort that only applies to injury cases. You want to change it as it is very bad if you have an injury to have limited tort, because the other company will fight everything. You should also look at getting uninsured and underinsured as they are pretty cheap and cover you if the other guy has no insurance.
You need to get estimates of what it costs to get your car fixed and give that to the other driver's insurance. Feel free to call me before you speak with them so you say things that will be taken out of context.
