Q: Im a father paying child support and loves his child. The mother moved out of state, is there any regulation against it?

Its been since thanksgiving of 2016 since I've seen my child and the mother makes it hard for me in every aspect. I was forced to pay child support because of my decision separate with the mother not my child. Child support started in Feb 2017 but the mother moved away in Dec of 2016. Is there any regulation against this? Do fathers not matter in this aspect? Especially the ones who actually want to be a part of their child life.

A: If you are not married in Georgia, the mother retains all rights to custody and visitation. That includes her right to move without notice. Father who wish to have rights must file for legitimation and custody. That helps to prevent move aways without notice.

A: Unfortunately, in the State of Georgia, when a child is born out of wedlock, the father has no legal rights to custody or visitation until he files a legitimation action. Until then, the mother holds all of the cards and can regulate when you see your child.
