Q: Mother with 2 teens want to move from FL to CO. Court order gives father no custodial rights. Do we need permission?

Teens are 15 and 17 and court agreement gives father only communication access and visitation only if the teens want it. If Father is given information on move, and address is that is all that is needed, or does a petition filed to the court asking permission to move still need to happen? Teens have had no visits with Father in two years other than at court hearings. Father is also 2 months behind on child support payments.

A: He has the right to visitation, albeit of the children agree. So yes, in theory the move could interfere with that visitation and so the custodial parent should ask the court for modification. Child support has nothing to do with it.
