Q: Real Estate law: What are my rights or Obligations under my contract, when dealing with a Bully for an Agent In Mich?

My Agent had a meltdown, it had actually all came to a head. I was walking on eggshells dealing with her since day one! Upon reflection I realized I have been bullied, and badgered since signing a contact to sell my home! Right after I signed she said you will lower price if it doesn't get an offer in 2 weeks right! I said we will see, and we already discussed What I was hoping to get, and it was already lower than I paid. See I keep forgetting I don't have to explain myself ugh. She said description and notes would say as is (for anymore updates or whatever) flyers or MLS never did, and flooring said vinyl after I checked in 3 rooms, I said no vinyl in my home could you please fix that? Asked her 5 times in 7 weeks nicely, as a matter of fact description had several mistakes. Ways of buying said FHA, Conventional also Should have said Those two plus VA and cash. After a few showings and feedback I told agent I decided to get quotes to refinish hardwood, she got mad and said I told

A: If the service you've received does not comport with the agreement you signed, you MAY be able to get out of the listing contract. Because you are 'dissatisfied' or feel like you're being 'bullied' is not enough -- there needs to be an objective failure to provide the services you contracted to receive. (E.g. if there is no listing in the multilist book x weeks after the contract, and that is specifically called for in the listing agreement... etc.)

Without seeing the listing agreement it is impossible to know what you can and cannot do, and I'd urge you to consult with a local real estate lawyer to help sort things out. You SHOULD have consulted a lawyer before signing the contract, but that is water under the bridge at this point.

You BEST option may be to hire a different agent, and have that agent work with the previous one to cancel the original contract. Again, don't enter into an agreement with the second agent without having that reviewed by a lawyer either!

There are lots of options, but without seeing the agreement you have now, it is impossible to know what you should or even can do. Seek local legal help!
