Yorktown, VA asked in Landlord - Tenant for Virginia

Q: Landlord has not replaced/repaired refrigerator

Our refrigerator broke 9/9/17. Since there is a warranty they had trouble finding a contractor that would take the job. A repairman came out 9/15/17. The only refrigerator we had was one in the garage that leaks out what appears to be water, even though it is not hooked up to water. It would soak our food and I didn't feel that it was sanitary. Then 9/18/07 the landlords insisted on renting a refrigerator. They will only allow it in the garage. It is not hooked up to water and we do not have ice. The owners want to declare the refrigerator a lemon. Apparently it has had nothing but problems. Is there a time limit, and is it acceptable for them to only provide a refrigerator in the garage? It is very inconvenient when preparing meals to hay everything in, and then haul it back. This is not what we agreed to in the lease. Can we be compensated? Can we have a refrigerator in the house and when? Can we be compensated for the lost food since they knew the refrigerator was problematic?

A: The Code of Virginia does not address a refrigerator matter like the one you described. I suspect there is nothing in the lease that addresses a problem like the one you described. The only way to reach an answer is to file a lawsuit against the landlord and have a judge decide the questions and your claims. You may want to confer with a lawyer who practices near your residence in Yorktown, VA. My office is in Alexandria, VA.
