Q: Landlord refuses to allow one person off a month to month lease without both people moving.

Been on a month to month lease and one person is moving out and wants off the lease. Landlord refuses to do that unless both move and second person isn't wanting to. Person moving doesn't want to remain on the lease and risk having an eviction on their record if the other person chooses not to pay some day down the road. Any way to have landlord remove them from the lease?

A: Either landlord or (both) tenants can terminate a month to month lease at the end of any month, by giving at least 30 days written notice. So if one tenant moves out without giving notice, that does not terminate the lease. Then if the full rent is not paid by the remaining tenant, the landlord can then sue both tenants for the full rent amount and collect from one or both, and also evict the remaining tenant. Even if the landlord doesn't evict, landlord can report non payment of rent to the credit bureaus, lowering the tenants' credit scores and making it more difficult to rent from a landlord who checks credit. So try to reach a mutual agreement, or give 30 day notice and move out.
