Rome, GA asked in Child Custody, Child Support, Domestic Violence and Family Law for Georgia

Q: Was I required to pay child support during the TPO?

Had a child custody visitation order in place then mother does false allegations and takes out of TPO we never step foot in a courtroom for the TPO over the past year-and-a-half and has recently been dismissed and there was no notification to either party I was at the courthouse and pulled the court file and seen it in there. Now we are petitioning for full legal and full physical custody of my daughter and the mother is requesting back child support for the past year-and-a-half. From the way I understood it since my visitation and my legal rights were dismissed due to the TPO replacing that order so is every other aspect of that order. There was an option for her to check to receive child support during the time of the TPO and it was not checked nor was any child support implemented in the TPO order. My question is do I actually owe back child support?

A: You are obligated to support any child that does not live with you, regardless of whether there was a child support order in place.
