Upper Darby, PA asked in Family Law, Child Custody and Child Support for Pennsylvania

Q: Should I take this to court?

I have a 1 year old daughter. Her mother and I recently broke up and she's taking my daughter out of state to live with her parents until she gets back on her feet. My daughter was born in my state and holds residency here. I have a career and my own place. She currently has neither of those. Should I file for custody and what is the likelyhood I would receive it as a man?

A: The child's mother should not relocate the child from PA without either your written consent or a court order. There is a statute is PA dealing with the relocation of minors. I suggest that you consult with an experienced family law attorney as soon as possible to learn what options you have.
