Fort Pierce, FL asked in Real Estate Law and Landlord - Tenant for Florida

Q: Renting in FL. Got 15 day notice to end month to month lease and be out 10/9. Sept rent paid. Can Oct rent be prorated?

1st year lease ended Dec 2014. Rent was monthly due 1st of every month. After the first year, landlord did not provide a new lease but continued to accept monthly payments and we were notified that it was now a month-to-month lease. So If on 9/20 we are given 15 day notice to vacate by 10/9, must I pay the full rent for October if we don't vacate before Sept 30?>

A: No way to say what the rental period is without reviewing or knowing the lease period which is not stated in your post. I suggest that you should consult with a tenant attorney in your area to see what your options are.

Good Luck,
