Q: My son rented a truck that turned out to have bad brakes

- he was involved in an accident and another person was injured - is my son on the hook for all of this, or can we go after the truck company?

A: Turn it over to his insurance and let them figure out who to go after.

A: You son needs to turn it over to his car insurance company. The insurance company will both defend him and will try to use the defective brake issue to try to get out of paying for the claim and will make a cross claim against the car company and try to make them liable. There really isn't any other way to deal with this economically.

A: Son should turn it over to his insurance. If he was hurt contact a member of the Oregon Assn for Justice--they give free consults. If your son is sued his insurance will provide represenstation, but he'd have a claim against the rental company for that responsibility.
