Q: I got hurt at work and I have been told I need therapy. My employee agreed to this but said that I needed to schedule

My Appt's before or after work because they would not pay for that only mileage, is this legal for employers to do?

A: If you don’t already have a Worker’s Compensation lawyer, you need to get one right away. Your employer is not going to make sure that your rights are protected. You have to do that by retaining your own workers compensation attorney.

A: Sadly, yes; the California Labor Code requires only payment for the treatment and the mileage expense to and from the treatment, NOT lost pay for missing work for treatment. THE SOLUTION: PICK a treatment facility from the comp insurer's Medical Provider Network ( its MPN ) the provides therapy and doctor visits at times before and after your work shift. You do NOT have to treat with a facility picked by the boss or the insurance adjuster and you do NOT have to miss work when a facility will only see you in the middle of your workday. Be assertive and insist on appointment times outside of your working hours or walk out and get another clinic.
